Terms of Use
These Terms of Use (“Terms”) govern your access to and use of Open Casino (“the Service”), a social casino-style Discord Activity available at https://open-casino-tma.vercel.app/. By opening or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must comply with Discord’s Terms of Service and Community Guidelines. You must be at least 13 years old (or the minimum age required by Discord and applicable law in your region). The Service uses virtual currency only and does not offer real-money gambling.
2. Description of the Service
Open Casino provides entertainment games (including blackjack and roulette), tournaments, daily rewards, leaderboards, and related features inside Discord. All chips and premium chips are virtual tokens with no real-world monetary value. They cannot be exchanged for cash, cryptocurrency, or goods unless we explicitly state otherwise in a future update.
3. Discord Activity
The Service runs as a Discord Activity embedded in the Discord client. Your use of Discord is subject to Discord’s own terms and policies. We are not responsible for Discord’s platform, availability, or actions.
4. Account and Authentication
Access is provided through Discord OAuth. We create and maintain a game profile linked to your Discord account. You are responsible for activity on your Discord account. Do not share session credentials or attempt to access another user’s account.
5. Virtual Currency and Gameplay
- Virtual balances may be granted, won, lost, or adjusted as part of normal gameplay.
- We may change game rules, odds, rewards, or economy settings at any time.
- Purchases or top-ups, if offered in the future, will be subject to separate payment terms.
- We do not guarantee uninterrupted access, specific outcomes, or preservation of virtual balances.
6. Acceptable Use
You agree not to:
- Cheat, exploit bugs, use bots, or manipulate game outcomes.
- Reverse engineer, scrape, or overload the Service or its APIs.
- Harass other users or submit unlawful, abusive, or misleading content (including feedback).
- Circumvent security, authentication, or rate limits.
- Use the Service where prohibited by applicable law.
7. Intellectual Property
The Service, including software, visuals, audio, and branding, is owned by Vasiliy or its licensors. You receive a limited, non-exclusive, revocable license to use the Service for personal entertainment only.
8. Feedback
If you send feedback or support messages, you grant us permission to use that content to operate and improve the Service. Do not include sensitive personal data unless necessary.
9. Suspension and Termination
We may suspend or terminate access at any time for violation of these Terms, suspected abuse, legal requirements, or operational reasons. Upon termination, your right to use the Service ends immediately. Virtual items and balances have no cash value and are not refundable unless required by law.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICE IS FOR ENTERTAINMENT ONLY.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vasiliy WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED USD 100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER, UNLESS A HIGHER LIMIT IS REQUIRED BY LAW.
12. Changes
We may update these Terms from time to time. The “Effective date” above will change when we do. Continued use after changes means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Kyiv, unless mandatory consumer protection law in your country provides otherwise.
